1. Introduction
These Terms of Use apply to our website www.mofusand.com (the “Site”), which is owned or controlled by Spiralcute International, Inc. (“Spiralcute,” “we,” “our,” or “us”).
These Terms, together with any documents incorporated by reference (including our Privacy Policy), govern your use of the Site and other services, applications, or products offered by Spiralcute that refer to this Agreement.
By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
We may post content or invite feedback on third-party platforms such as Meta, Instagram, YouTube, Twitter, TikTok, and Snapchat (“Third-Party Sites”). Spiralcute does not control these platforms, and our Terms and Privacy Policy do not apply to them.

We currently do not collect personal data via the Site. If you email us, you consent to communication.
11. Waiver
Our failure to enforce any provision of these Terms shall not be considered a waiver of that provision or any other rights we may have.
12. English Language
These Terms and all related documents are in English.
13. Dispute Resolution
Arbitration Agreement
You agree to resolve any dispute with Spiralcute through binding arbitration. This includes:
Disputes relating to your use of the Site or any products or services offered
Disputes that predate the effective date of these Terms

Arbitrator’s authority: Final and binding decisions; may award any relief available under law
No jury trials
No class actions or group arbitrations
If a court rules that any part of the arbitration clause is unenforceable, that portion will be severed and heard in court in Los Angeles, California.
14. Choice of Law / Forum Selection
These Terms are governed by the laws of the State of California, excluding conflict of law principles.
15. Severability
If any part of these Terms is found unenforceable, the rest will remain in effect. Invalid provisions may be modified or removed to the extent necessary to be enforceable.
16. Entire Agreement
These Terms, along with the Privacy Policy and any related notices or agreements, constitute the entire agreement between you and Spiralcute regarding the Site. They supersede all prior agreements.
